Are Delta 8 and Delta 10 Legal?

This is due to the fact that they are both naturally extracted from the hemp plants, meaning that according to the Farm Bill their THC levels are not more than 0,3%. However, since these products are in the majority of cases chemically synthesised through isomerization, they can be classified as synthetic. The Federal Analog Act views these isomers as illegal since they are synthetically extracted, making them technically a controlled substance.

Are these products banned in certain states?

Unfortunately Delta 10 and Delta 8 are banned in eighteen U.S states. However, as the industry seems to develop and the stigma surrounding cannabis seems to change, certain states have become more progressive with states such as California leading the way for other pro cannabis states to get onboard. Delta 8 Minnesota is a hot topic as of July of 2022, the Minnesota Senate signed legislation for the Minnesota state law that regulates the sale of high concentrations of Delta-8 THC products while legalising the sale of edible forms of THC products.
